On August 8, 2023, the FTC filed a complaint against Automators AI and its affiliated entities, alleging that they caused consumers across the country over $22 million in harm.

Have you noticed that nearly every company these days claims to be AI-enabled? However, reality often falls short of these assertions. SEC chair Gary Gensler recently issued a warning to vendors against making false AI claims.

I strongly advise all startup leaders to refrain from making false claims, as the consequences can be fatal.

Several factors contribute to these false claims:

Marketing Hype: In the current landscape, marketing seeks something different to make campaigns attractive, and nothing seems more enticing than AI.

Corporate Pressure: Similar to the pressure a decade ago to make everything \”cloud-enabled,\” some teams now face corporate pressure to incorporate AI, regardless of its actual advantages or disadvantages.

Making Critics Happy: Investment gurus and analysts often favor AI, and companies may exaggerate its role to please them.

Sales Pressure: Sales teams, always seeking new functionalities to sell, find AI an attractive and easily marketable feature, leading to pressure on technical teams to incorporate it.

Types of False Claims:

Claiming AI when there is none: This is the most severe case and is arguably illegal.

Claim based on rule-based engines: Some companies project rule-based engines as AI, as they can make static decisions.

Exaggerating claims: Instances where AI may only increase productivity by 30%, but claims are exaggerated to 100%.

Claiming to solve unsolvable problems: Not every problem can be solved by AI, yet false claims are made.

Attempting to solve problems where no AI is needed: Overengineering solutions with unnecessary AI, which can be counterproductive.

False claims have a limited shelf life, and customers are unforgiving. Once exposed, the repercussions can be severe, including legal implications. Therefore, my advice is simple: refrain from making false AI claims.
